Terms on quote as follows:
"By accepting our quote or making any payment, you agree to these Terms and Conditions for Alford Yardworks’ landscaping services in Canberra. If you have questions, let’s have a yarn!
- Scope of Work
All work, including landscaping, paving, excavations, and garden beds, is as per the agreed quote. Changes to the scope will require a written variation and may incur additional costs, discussed with you beforehand.
- Payments
A 10% non-refundable deposit is required to lock in an estimated start date. A 50% pre-start payment must be made before breaking ground, with the remaining balance due upon job completion; for larger jobs, we may agree to multiple progress payments based on milestones, detailed in the quote. Late payments incur 8% interest per month (or part thereof), and extreme cases may be referred to debt collection.
- Cancellations
Cancelling with less than 24 hours’ notice incurs a fee of 50% of the quoted amount or all costs incurred by Alford Yardworks, whichever is greater. Cancelling within 14 days but more than 24 hours of the start date incurs a 25% fee of the quoted amount to cover scheduling costs. We’ll confirm cancellations in writing to avoid confusion.
- Site Access and Conditions
You must provide reasonable site access (e.g., clear entry for equipment) and onsite facilities (toilets, clean drinking water) to avoid delays or extra travel/downtime charges ($250/hour minimum + travel). Prices for excavations and tip fees assume clear ground (no rubbish, rock, roots, or hidden pipes/drains); any variations will be discussed, with additional costs agreed before proceeding. You must provide access to the worksite and building materials for reasonable purposes (e.g., inspection, material removal) during reasonable hours by agreement until payment is made in full, including any variations. If the job has started and you block access to the site for any reason, a daily fee will apply after written notice to cover all costs incurred, such as labor, equipment downtime, running costs, and lost scheduling opportunities.
- Underground Services and Locating
We perform a “Dial Before You Dig” check, but its information is limited and not guaranteed. Locating services can be provided at an additional cost (quoted upon request); if not requested, we assume you confirm the area is clear, and any damage to utilities or services is at your cost.
- Client Responsibilities
You’re responsible for obtaining necessary permits or approvals (e.g., council permits for landscaping work) and ensuring the job site is free of pet feces to maintain a safe and hygienic work environment. Alford Yardworks will clean up excessive pet feces at our hourly charge-out rate of $250/hour (minimum); we’re not liable for delays or costs due to unprovided permits, restricted access, or unclean site conditions.
- Delays and Force Majeure
Delays due to weather or unforeseen events (e.g., strikes, natural disasters) may occur, but we’ll keep you informed and reschedule promptly. We’re not liable for delays beyond our control.
- Materials and Workmanship
We use high-quality, locally sourced materials to ensure lasting results for your yard, and our work carries a 7-year workmanship warranty, compliant with industry standards. Client requests not aligning with or exceeding current building practices will void the warranty; we may, at our discretion, use onsite materials for recycling if available; and Alford Yardworks retains ownership of all materials and workmanship until the job is paid in full, including any variations.
- Site Visits
Each job includes one free site visit. Additional visits incur a call-out fee of $250/hour (minimum) plus travel costs, agreed in advance.
- Insurance and Safety
We’re fully insured for public liability and workers’ compensation. You must ensure a safe work environment (e.g., no hazardous conditions); we’re not liable for injuries or damages due to unsafe site conditions provided by you.
- Liability
Alford Yardworks is not liable for costs or damages due to client-provided access issues, including anything blocking access not in our direct control (e.g., parked vehicles, third-party obstructions), permit delays, pre-existing site conditions, or utility damage where locating services were declined. Our liability is limited to the cost of services provided.
- Termination
We may terminate the contract with written notice if terms are breached (e.g., non-payment) or due to harassment, abuse, bullying, violence, or any behavior we deem a psychosocial work hazard, and we may refer such matters to ACT WorkSafe, police, or other relevant authorities if necessary. You’ll be liable for costs incurred up to termination.
- Dispute Resolution
We aim to resolve disputes through friendly discussion. If needed, we’ll pursue mediation or arbitration before legal action.
